Copyright Notice:
- The Photographer, Nidal Battikha Photography LLC, dba Battikha Photo and Video, owns the image copyrights. Clients get permission to use the images through licenses, not full ownership.
Using Real Estate Photos:
- The client who paid for the service can use the images to advertise the property electronically or in print. This permission lasts until the property sells/rents or for one year, whichever comes first, without reusing them unless the Photographer agrees in writing.
- Images can’t be sold or given to others, including different agents or property-related parties. These image licenses can’t be transferred.
- The Photographer can license the photos to others as well.
Expectations and Rules:
- Before a photo shoot, the property should be ready. The Photographer isn’t responsible for staging, cleaning, or landscaping unless agreed upon with an additional fee.
- Cancellations or rescheduling within 24 hours may incur a fee. Rescheduling due to weather (rain, snow, heavy fog, etc) allows rescheduling without a fee.
- Rush requests within 12 hours might incur an additional charge.
Photo Quality and Delivery:
- The Photographer aims for top-quality images. Re-editing is possible within certain limits. Extra requests may have additional charges.
- Photos and floor plans usually arrive within 24 hours. Video and other media usually arrive within 48 hours. Access to download lasts for as long as the property is still available or up to one year, whichever comes first. After that, a fee might apply for retrieval.
Extra Charges and Right to Refuse:
- Properties outside a 40-mile radius from Lincoln, RI may have an added travel fee. The Photographer can refuse service at their discretion.
Payment Terms:
- Payment is due within 7 days of getting the proof images or by the stated invoice date. Images are shared upon payment. Late payments may lead to fees and legal action may result after 60 days.
